HARDIN COUNTY, KENTUCKY -- There are more legal problems for Ursa native and soldier Brent Burke Monday morning.

The brother of Burke's estranged wife and their two children are listed as the plaintiffs in a wrongful death suit against Burke.

According to the local newspaper the News Enterprise, the case alleges three counts of wrongful death, death by deadly weapon and loss of consortium.

Brent Burke had been the main suspect in the 2007 shooting deaths of his wife Tracy and her former mother-in-law.

But that case was closed six months ago when a Hardin County, Kentucky Circuit Court judge dismissed criminal charges without prejudice.

Right now Burke faces general court martial from the military at Fort Campbell February 6.

The former military police officer is still in the Christian County Jail in Kentucky.
