Case against Niekamp continued to August

The following information came from WTAD News:

Parts of the Quo Warranto complaint against Quincy school board president Melvin J. "Bud" Niekamp have been dismissed,  but the case has been continued to August.

Judge Diane Lagoski heard a request on Monday morning from Niekamp's attorney, Bob Adrian, to dismiss the suit.  Lagoski rejected the dismissal.

And after hearing from both Adrian and the attorney for the plaintiffs, Jack Inghram, Lagoski suggested that several paragraphs of the suit could be deleted.

The suit was brought because Niekamp was a member of the Adams County Board at the time he was sworn in as a Quincy School Board member.

An Illinois Attorney General’s opinion is that two offices are incompatible.

School board members Glenn Bemis and Bill Daniels, and former board member Carol Nichols now charge Niekamp with violating the Public Officers Prohibited Activities act, which prohibits a County Board member from serving simultaneously on a school board in an Illinois county with a population of 40,000 or more.

Paragraphs dealing with the issue of incompatibility have, however, been cut from all three complaints against Niekamp.

Paragraphs dealing with the fact that Niekamp is president of the school board also were deleted because they are unnecessary.  Inghram agreed those paragraphs no longer were necessary in pursuing the complaint and said the complaint now is more streamlined.

Inghram's motion for summary judgment was to have been heard on June 29, but that has been delayed until August 12 at 1:30 p.m.

Adrian has been ordered to respond to the new charges by July 12 and Ingrham has been given until July 26 to reply to Adrian.

Judge Lagoski has asked that all motions that can be addressed be ready by the August 12 court date.
