MOBERLY, MO. -- The man accused of hitting an Amish buggy from behind with his car may soon know if he'll get a trial.
That January accident killed the buggy's driver near Moberly, Missouri.
The Hannibal Courier-Post reports a preliminary hearing is set for November 17th.
That hearing will decide whether the Staunton, Illinois man will go to trial.
The man is charged with second-degree manslaughter.
He told authorities he did not see the buggy and tried to avoid it.
Although records showed he sent a text message two minutes before the crash, he says he was not talking on the cell phone or texting at the time of the accident.
