DES MOINES, IOWA -- Lee County District Court Judge Michael Schilling assessed a $42,000 civil penalty against Feinberg Metals Recycling Corp., Betty Feinberg, Marty Feinberg, and Phil Feinberg, for a variety of solid waste and storm water management violations occurring at their Fort Madison and Lockridge recycling facilities. The consent decree resolved a lawsuit filed by the State on Thursday.
The lawsuit, filed by Attorney General Tom Miller, alleged that the defendants failed to properly store and handle discarded appliances, so as to prevent damage to electrical capacitors, refrigerant lines and compressors, and mercury-containing components. The suit also alleged that defendants failed to comply with a variety of storm water management requirements. The allegations include the failure to timely obtain a storm water discharge permit for the Lockridge facility and to develop and implement pollution prevention plans for both facilities.
The Court’s order enjoined the defendants from further violations. In addition, the Court ordered the defendants to submit their pollution prevention plans to the Iowa Department of Natural Resources within 30 days, maintain and implement the plans, refrain from demanufacturing appliances without first obtaining a permit, and keep detailed records of their handling of discarded appliances.
