MARION CO., MO. -- A Marion Co. man shot and killed a neighbor's dog and injured another Wednesday after they attacked his sheep, the Marion County Sheriff's Office said.

Deputies were called to the scene at about 10:30 p.m. near the intersection of County Roads 404 and 407.

Marion County Sheriff Jimmy Shinn said the two dogs roamed the area and entered the property. Shinn says evidence shows the dogs attacked the property owner's pet sheep and then tried to attack the owner's small dog. Shinn did not release the name of the shooter.

"The shooter acted without malice," Shinn said. "He was protecting his person and his property."

The man told investigators that he tried to scare the dogs away, but when they became more aggressive, he had to shoot them, according to Shinn's press release.

Scott Minor owned the male dog Maclin.  His father Dick Minor owns the dog Maggie.

"It's an unfortunate situation," Scott Minor said. "We can never know exactly what happened, but it seems like we both lost a lot."

He had to put Maclin down.  Maggie is at a local veterinarian's office recovering from gunshot wound.

Minor described the dogs as gentle and said that he let them out regularly to run without issue.
