Accident near Hamilton, IL that killed 6 year old

HANCOCK CO., ILL. -- The Iowa man arrested for a fatal hit and run accident near Hamilton Illinois Monday, December 28th has plead not guilty.

42 year old Gary Mason waived his right to a preliminary hearing Wednesday, January 6th at the Hancock County Courthouse.

He pleaded not guilty to all eight charges.

-Two counts of Aggravated Leaving the Scene of an Accident Involving Death or Personal Injury. One count is a Class 1 felony, the other is a Class 2 felony.

-Two counts of Leaving the Scene of an Accident Involving Death or Personal Injury. Both Class 4 felonies.

-Two counts of Driving While License Revoked.

-Two counts of Failure to Get Information or Render Aid.

Mason was arrested after the trailer he was towing broke free and hit an oncoming car December 28th.

Six year old Emina Smajlovic of Hamilton was killed in that accident.

A pre trial conference will be held March 1st.

At that conference Mason and his attorney can either waive the right to a jury trial, go ahead with the jury trial or ask for a continuance.
