Quincy judge says Diaz will remain guilty

A judge in Adams County denied the request of a Chicago man who asked to withdraw his plea to a 2010 murder in a Quincy restaurant parking lot.

Phillip Diaz, 30, pleaded guilty in May to first-degree murder with a plea arrangement that would have given him anywhere between 20 and 45 years in prison.

Diaz was charged with the May 2010 shooting death of 38-year-old Ian Barksdale. The shooting took place in the parking lot of Hardees on 30th and Broadway streets.

Judge Scott Walden originally sentenced Diaz to 45 years in state prison.

It was Walden on Tuesday who denied Diaz the ability to withdraw his plea. Diaz complained that his attorney didn't properly investigate the case.
